The following terms and conditions apply to all website development / design services provided by Creative Web Design 123 to the Client.
Mission
To provide you, the customer with the highest quality products and services at a fair and reasonable price. Our goal is to meet and even exceed your expectations.
CUSTOMER MUST READ THIS AGREEMENT CAREFULLY and by accepting proposals or statements of work has agreed to all terms and conditions stated by Creative Web Design 123. Signature is not required by either party for enforcement of this agreement and this agreement is implied with payment or request of services.
Upon acceptance of a quote, proposal or agreement made with Creative Web Design 123, the following is eVision Media’s terms and conditions that are assumed to be agreed to when entering into a working arrangement with us.
Payment
Payment is made prior to any work being carried out unless otherwise agreed with Creative Web Design 123.
We try to ensure all prices are correct on our website but in the unlikely event of an error you will be either be refunded your payment in full or asked to pay the difference.
Upon acceptance of a proposal for website, SEO projects or larger projects, Creative Web Design 123 requires half payable immediately before any work will begin on the project. The remaining amount owed will be due when the project is complete or the time frame noted in the estimate of acceptance of the proposal – whichever occurs first. If the project is not completed by the estimate time frame, for any reason, the final payment is still due and the project will continue to be completed as outlined in the initial proposal.
Down Payments and Refunds
The down payment is non-refundable unless Creative Web Design 123 has not begun working on the project in any way. Qualified refunds will be given up to 30 days upon acceptance of quote.
For smaller projects, full payment is required up front before any work will begin.
Intellectual Property
It is your responsibility to ensure that any images and text sent to us do not infringe any intellectual rights. Any images provides by us will be royalty free stock images.
Completion Schedule
A completion date will be agreed with you at the start of your order. Every effort is made to meet completion dates but we can not be held liable for any losses incurred due to a delay in completing your website.
Amendments
Once you have approved your site and it has been launched, future amendments will be quoted and invoiced.
Scope of Project
If, during the project timeline, new deliverables are added or time to complete the project is running over the estimated time it would take, there might be a need to adjust the overall project cost to reflect the extra hours spent. You will be advised if this occurs and available options will be discussed at that time.
Content
It is expected that all information (text and images) relating to the website will be provided by yourself or someone you have appointed for the task (unless alternate arrangements have been made). All new content is to be provided in digital format, either via email or in a Text/Word document. Any digital images you provide should be in their original format (scanned at 100%) and we will adjust them to suit the area they will be placed in on the site.
Hosting
Hosting is an annual charge which must be paid in advance for the whole year.
It is the client’s responsibility to renew the hosting in time ie. before the expiry date. Failure to renew in time can lead to loss of files, data, emails, backups etc. All unpaid hostings are disabled or deleted from the server.
All renewals must be paid by seven working days prior to the expiry date. Creative Web Design 123 will not be responsible for issues relating to delayed payment.
Hosting are on shared and non-shared servers hosted via third party providers. Creative Web Design 123 ensures best to our ability that our systems and servers are protected from hackers, viruses, intruders and other online and offline problems, however we will not be held liable for any disruption of services if such situation arises.
Client is solely responsible for the content stored on and served by the hosting service purchased and the activity of any scripts or email services created under the hosting service. The Customer must maintain the security of all account passwords and applications or scripts and ensure all scripts under the hosting service are free from malicious content that may harm any part of the Server, other client accounts hosted, or the external systems of visitors viewing the hosted content.
Incase of a malware attack, Creative Web Design 123 reserves the right to delete files on the hosting service without giving any prior notice.
Hosting Cancellation/Termination
Hosting Cancellation requests must be sent in writing or by email one month prior to the expiry of the same. Once the hosting has been renewed, it cannot be cancelled and must be paid for the full year.
If the hosting is not paid and renewed before the expiry date. We reserve the right to disable the hosting and all associated services including emails and dns records. Additional charges will be applicable to re-enable the hosting. Creative Web Design 123 will not be responsible for any loss of data, files, emails, backups, restoration costs etc.
If a hosting has been cancelled / disabled then all files, emails, databases and backups will be deleted from the server without any notification to the client.
Once all invoices are paid, it is client’s responsibility to request for the files subject to the below:
Emails
All emails are to be downloaded on the client’s computer periodically. Email boxes must be kept within their quota limits. Periodical maintenance may be carried out on the email box and emails older than 6 months are deleted.
Client’s must not use the email hosting for inappropriate content and other undesired emails which can result in spamming or infecting the server. Under such circumstances, immediate action will be taken and the required files and data will be deleted without any prior notice.
Creative Web Design 123 offer packages in co-ordination with third party providers. Changes to the third party provider’s rules and policies may ultimately effect the services we provide or the terms and conditions herein.

Domain
All domain registrations and renewals are to be paid in advance.
Expiration of a domain can result in service disruption and loss of domain.
Creative Web Design 123 will not be responsible if a domain expires due to non-payment / late payment of the charges. All payments must be made by seven working days before the expiry date.
It is client’s responsibility to renew their domain names with us.
All invoices and dues must be paid in full before we release the requested domain name.
Creative Web Design 123 has the domains in a common pool account and therefore cannot give access to its domain control panel.
Creative Web Design 123 offer packages in co-ordination with third party providers. Changes to the third party provider’s rules and policies may ultimately effect the services we provide or the terms and conditions herein.
